回国的理由

刚来的时候铁了心这辈子要在美国混出个头脸来(和签证官说的念完书立马回国那都是鬼话——一个十七八岁的小孩哪能对自己的将来作出什么保证),然而不知不觉的,想法就变了,不知什么时候就热切盼望着快快地把该念的书念完就可以回国长住。

前几天链的一片关于回国理由的文章我觉得算是写出了诸多留美学生的想法。也曾有友人对我说过,国内太黑了,尤其是官场,你回去肯定不适应。我大多一笑了之。国内黑,美国也黑,天下乌鸦一般黑,只不过邻居家的草看上去总是绿一点罢了。友人不解,我也不加以说明。美国之黑,是明目张胆的黑,是光天化日合法化的黑,是不仔细回味亲身体验不能发现的黑。

举例说明。bratcat发来一篇文章,是一个亚裔美国人在抱怨affirmative action。这么好听的一个名词,其实掩盖着一个十分黑暗的动机。

所谓affirmative action,是学生入学时一些少数民族学生能得到照顾优先入学的一项政策。注意说的时“一些”而不是“全部”少数民族。这项政策只有印第安人,黑人和拉美后裔可以享受,其他少数民族如亚裔,非但得不到照顾,反而入学条件要苛刻些。名义上affirmative action的动机是给因为祖辈受到白人不公正待遇而生来处于逆境的学生们以额外的照顾,让他们能有机会接受良好教育,拉平社会差距。咋一听似乎有理:

印第安人说:你们白人祖宗欺负我们祖宗,所以我们享受特殊待遇有理。
黑人说:你们白人祖宗奴役我们祖宗,所以我们享受特殊待遇有理。
拉美后裔不知该说什么,估计他们祖宗和白人祖宗也有些过节,所以我们享受特殊待遇有理。
然而亚裔的祖先们也被白人驱赶着流血流汗,他们的后代却非但得不到政策上的优待,却反而要比白人更加优秀才能入学。

堂而皇之的掩盖之下,其实美国白人主流社会提倡affirmative action的理由很简单:黑人群体曾有破罐子破摔的倾向,认为白人的法律是白人为白人制订的,黑人不懂也不应该去遵守,于是成为社会不稳定因素。于是便有了这么个对黑人放宽入学条件的政策,吸收一些黑人入学,让其中的一些人按白人的游戏规则办事,树立一些典型,以缓和社会矛盾。仅此而已。

别的“黑”不说,就拿上大学这件事简单做个中美之间“黑”的程度的比较。

美国:走后门是基本国策

中国:分数低的入学要交赞助费
美国:分数低的入学还拿奖学金

中国:托人送礼拉关系求爷爷拜奶奶
美国:招办主任亲自打电话说你快来

中国:特殊途径进来的学生不会大肆张扬
美国:偶是牛校的气死你活该哇哈哈哈哈

可惜多少逆境中长大的亚裔孩子从小苦到大,没比哪个黑孩子少吃苦,学习得大多比黑人努力多了,到头来的待遇却大相径庭,如此看来,国内为人诟病的“太子党”也不那么可怖了。

法学院申请完一圈,看了不少也听了不少,颇多感触。在亲身经历以前不觉的这个政策有什么特别不妥的地方,然而一年下来的观察中发现美国这个affirmative action,断送了不知多少白人和亚裔孩子的前途,从优异学生的手中活生生地抢走位置给成绩上差距巨大的黑人,一个个还狂妄得不行觉得自己肯定是实力超强而不是靠affirmative action这个后门进来的,让我这个一直自诩为局外人的也看得义愤填膺。

所以就像开头说的,美国之黑,是没有亲身经历过的人不能理解的,affirmative action只是其中一个小小的黑点罢了。外人看起来,井井有条的一个法制社会,却不知道里面其实“很黑很黑”(借友人描述中国社会用语),并不是什么事情都有道理好讲的,弱势群体还是很受欺负的。

留学生们在美国大约是弱势群体中的弱者,受的欺负更多,上到美国联邦政府,下到学校留学生办公室的秘书,都可以给你脸色看你还得赔着笑脸点头哈腰因为要为自己的前途打算——谁让你是外国人呢?也是,咱回国就成本国人了,好歹还是强势群体不是?

不是吃不着葡萄,而是这个葡萄实在不如咱家的甜。

    I’m the guy who recommended it on mitbbs. I got my phd from UMCP.

    I got admitted by GULC. I took the LSAT again in June and just got
    my score, 178 (my 1st score, in Feb., is 168). I hope it can help me to
    apply for scholarship. I do not read extensively on English discussion boards. Based on your experience, do you think they can accept a 2nd
    score for scholarship? I will be in part-time program, but thinking about
    convert to full-time later.

    damao, wow that’s a GREAT score. I doubt if it would help you in scholarships though because at this point in the game, all funds are allocated. It never hurts to try, though, and you are in an extremely good position to transfer, if you are considering it, to either the fulltime division or other schools.

    America is a legal society.

    Justice is not the purpose. Unfairness can be justified and institionalized, as long as it is done consistently.

    That’s the whole point of precedents – if a mistake is made once, it can be made correct by making similar mistakes consistently in the future. So the mistake becomes the law.

    As lawyers, we learn the laws, and inevitably, we learn the mistakes and enforce them.

    As far as Affirmative Action is concerned, it is to counter-balance another form of discrimination in the admissions process: legacy and discrimination against non-elite undergrads.

    Legacy is simply a way to reward the children of upper-class alumni who can afford to make donations to the school.

    Discrimination against non-elite undergrads is a cunning way to discriminate against middle and lower class whites and Asians. Since undergrad colleges also practice Affirmative Action, middle/lower class whites and Asians either can’t get in, or can’t afford it after they get in, since the scholarship is diverted to reward “Affirmative Action Admits”.

    Therefore, both whites and Asians of non-privileged backgrounds are discriminated twice in the law school application process. The admitted class in top schools tend to consist a portion of wealthy, Ivy-league educated students, and a portion of Afirmative Action admits who are great for PR purposes. If you are a poor white or Asian with stellar grades/LSATs, you are often denied admissions for fake reasons such as racial diversity and undergrad quality — instead of real reasons of racial appeasement and economical gains for the school.

    Thank you for the prompt reply. I will try with GULC. I bought a house, my wife has a good job, and I have a 3 year old daughter. So I’m hesitate to leave DC area.

    同意littlenorth,要想生活在完全纯净的环境里,除非是生活在真空里了。如果实干法律这行,可能就更得面对实际环境了。anyway,也恰恰是法律这行,能有机会做出些改变实际情况的事,多多少少罢了。
